These Terms of Use ("Terms") are the agreement between you and Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi ("newyares", "we", "us") for the LevelUp app on iOS and Android, the LevelUp Pro subscription, and the LevelUp services behind them (together, "LevelUp"). Please read them, and keep a copy if you like: you can save or print this page at any time.
1. Who we are and how these Terms apply
#Operator
LevelUp is provided by Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi. Our address, phone, email, tax ID and other details are on our Support page.
Accepting these Terms
LevelUp has no sign-up form. Your account is created when you first open the app. The introduction screens you see first link these Terms and say, under their Continue button: "By continuing, you agree to our Terms of Use and Privacy Policy. We collect usage analytics to improve LevelUp; you can turn them off anytime in Settings." By continuing past the introduction and using LevelUp, you accept these Terms. If you do not accept them, do not use LevelUp, and delete the app.
Before you post in the community for the first time, the app asks you to agree again, as described in Acceptable use. When you share a quest, you tick "I agree to the Community Guidelines and the Terms of Use."
If you are under 18, read these Terms with a parent or guardian (see Who can use LevelUp).
What else applies
-
Community Guidelines. The Community Guidelines (version 2026-11-01) are part of these Terms.
-
Privacy Policy. Our Privacy Policy and the KVKK Aydınlatma Metni explain how we handle personal data. They are information we give you, not part of this contract. Accepting these Terms is not consent to any processing of personal data. Where we need your consent, for example before an AI plan is written, the app asks for it separately.
-
App store terms. You get the app and LevelUp Pro through Apple's App Store or Google Play, and their own terms also apply to that. See Apple App Store and Google Play.
Apple's Standard EULA and these Terms
These Terms are written to work in either of two ways, depending on the App Store country or region you got LevelUp from.
- If we have given these Terms to Apple as LevelUp's licence agreement for your country or region, they are the end-user licence agreement for the app on Apple devices, in place of Apple's Licensed Application End User License Agreement (the "Standard EULA").
- If Apple's Standard EULA applies to your download, it governs your licence to use the app, and these Terms apply to LevelUp as additional terms. Where the Standard EULA and these Terms conflict, the Standard EULA wins as far as the conflict goes, and these Terms apply to everything else.
2. Who can use LevelUp
#- You must be at least 13 years old to use LevelUp.
- Where the law of your country sets a higher minimum age for a service like LevelUp, or for agreeing to these Terms or to data processing without a parent's consent, you must meet that age, or have a parent's or guardian's consent where the law allows it.
- LevelUp is not directed to children under 13. If we learn that an account belongs to someone under 13, we will suspend the account and then delete it and its data.
- LevelUp does not ask for your age or verify it today.
- LevelUp may not be offered in every country, and some features may not be available everywhere.
If you are under 18
- Use LevelUp with a parent or guardian's knowledge, and read these Terms and the Privacy Policy together.
- Buying LevelUp Pro. If you are under 18, you need a parent's or guardian's permission to buy LevelUp Pro. Purchases are made with the Apple ID or Google account they are charged to. If your account is part of a family group, a parent can approve or block purchases with the store's family features, such as Apple's Ask to Buy or Google Family Link. If a child bought LevelUp Pro without permission, the parent can ask Apple or Google for a refund, or contact us.
- Where the law requires a parent's consent and it was not given, we will not enforce these Terms against a minor.
- What you publish in the community is public. Do not share your real full name, where you live, your school or other personal details in your nickname, quests or comments.
3. Your account
#- Anonymous account. LevelUp creates an anonymous account for you when you first open the app. There is no sign-in, email or password in this version. Your account is tied to the app on your device, not to a login.
- You can lose it. If you lose or reset your device, delete and reinstall the app, or move to a new device, your account and everything in it (quests, progress, level, character, skills and streaks) can be lost. In this version we have no way to recover a lost account or move it to another device.
- LevelUp Pro comes back. Your LevelUp Pro subscription belongs to your Apple ID or Google Play account, not to the device. On a new account, open Profile › Settings › LevelUp Pro and use the restore option with the same store account you subscribed with; this normally brings Pro back. Your quests and progress do not come back this way.
- What you published stays public. If you lose access to an account, the quests and comments you published from it stay visible until they are deleted. Email us at [email protected] if you want them removed. Because accounts are anonymous, we may not be able to identify your account without details from the app, such as its Support ID.
- Keep your device secure. Anyone who can use your unlocked device can use your LevelUp account. Home-screen and lock-screen widgets can show your quest titles and tasks.
- One person, one account for free extras. The free AI plan and the free weekly-rebuild preview are given once per account and once per device (see LevelUp Pro). Do not create new accounts or change device identifiers to get them again.
4. Licence to use the app
#- We give you a personal, limited, non-exclusive, non-transferable and revocable licence to download, install and use the LevelUp app on devices you own or control, for your own non-commercial use, under these Terms and the rules of the store you got it from. On Apple devices this licence also follows the Usage Rules in Apple's Media Services Terms and Conditions, including Family Sharing where it applies.
- LevelUp, its software, design, characters, classes, icons, official quests and texts belong to newyares or our licensors. These Terms do not give you any other rights in them.
- You must not, and must not help anyone else to:
- copy, modify, sell, rent, sublicense or distribute the app;
- reverse engineer, decompile or disassemble it, except where the law allows this despite this restriction;
- access LevelUp's servers other than through the app, or use bots, scrapers or other automated means;
- get around security measures, the free-use rules, fair-use limits or Pro checks;
- interfere with or overload LevelUp, or use it to break the law.
- Updates. The app may check for and download updates when it starts. Some features, such as AI plans, may need the latest version.
- Third-party services. LevelUp works with services from other companies, such as Apple, Google, Anthropic and RevenueCat. When you use the app you must also follow the terms that apply to you for those services, such as your mobile data contract.
5. LevelUp Pro
#What it is
- LevelUp Pro is an optional auto-renewing subscription. It comes as a weekly or a yearly subscription.
- You buy it in the app through Apple's App Store or Google Play. The purchase is charged to your Apple ID or Google Play account when you confirm it, or, if you start a free trial, when the trial ends. Apple or Google processes the payment; we never see your card details.
- Price and period are as shown in the store's purchase screen before you confirm, including the currency and any taxes. Prices can differ by country.
- How you subscribe. You choose a plan on the LevelUp Pro screen. The store then shows its own purchase sheet with the price and billing period, where you can confirm or cancel before you pay. Your receipt comes from Apple or Google.
- Who sells it. On the App Store, Apple sells LevelUp Pro on our behalf and takes the payment (in Türkiye and the EU, Apple Distribution International Ltd.). On Google Play, Google sells it on our behalf in the EU, the EEA and the UK; in Türkiye and other countries, we sell it to you through Google Play's billing. In every case, we provide LevelUp Pro and are responsible for it.
Pre-contract information. Provider: Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi, Fikirtepe Mahallesi, Rüzgar Sokak No: 44A, A1 D: 197, 34720 Kadıköy / İstanbul, Türkiye, phone +90 532 698 88 78, email [email protected]; our tax ID is on our Support page. Service: LevelUp Pro, an auto-renewing weekly or yearly subscription with the features in Free and Pro. Price: the total price including taxes, shown on the store's purchase sheet before you confirm. Your order means you must pay, through your App Store or Google Play account. Withdrawal: see Right of withdrawal. Ending it: you can cancel at any time (see Renewal and cancellation). Complaints: [email protected]; consumers in Türkiye can also apply to the Tüketici Hakem Heyeti or, after mediation, the consumer courts (see Law and disputes). Keep a copy: save or print this page.
Renewal and cancellation
- It continues until you cancel it. Your subscription has no fixed end: it continues and is billed at the start of each weekly or yearly period, at the price then shown in the store, until you cancel it. The store can charge up to 24 hours before a new period starts, so cancel at least 24 hours before the renewal date to be safe.
- Manage or cancel it in the store's subscription settings:
- iPhone or iPad: Settings › [your name] › Subscriptions.
- Android: open the Google Play app, tap your profile icon, then Payments & subscriptions › Subscriptions.
- In LevelUp: Profile › Settings › LevelUp Pro, which opens subscription management for Pro members.
- When you cancel, you keep Pro until the end of the period you have paid for. It does not renew after that.
- Türkiye: ending it at once. If you are a consumer in Türkiye, you can also end the subscription with immediate effect at any time and get back the part you have paid for but not used. For App Store purchases, ask Apple Support. For Google Play purchases, email us at [email protected]; we end it within 7 days and refund the unused part within 15 days.
- Price changes. If the price of your subscription changes, the store tells you in the way its rules require, and you can cancel before the new price applies.
Important
Deleting the app or your LevelUp account does not cancel LevelUp Pro. If you subscribed, you will keep being billed until you cancel it in the store.
Free trial
- When the store offers a free trial (for example on the yearly subscription), the purchase screen shows it, with its length, before you confirm.
- A free trial turns into a paid subscription at the end of the trial unless you cancel it at least 24 hours before the trial ends.
- If you buy a subscription during a free trial, any unused part of the trial ends.
Refunds
Refunds for purchases made through the App Store or Google Play follow the store's refund policies. For App Store purchases, Apple decides on refunds; we cannot refund them ourselves. For Google Play purchases in the EU, the EEA and the UK, where Google sells LevelUp Pro on our behalf, request a refund from Google Play; you can also contact us. For Google Play purchases in Türkiye and other countries, we sell LevelUp Pro to you, so email us at [email protected] and we handle your refund request.
Right of withdrawal
If you are a consumer, the law of your country may give you a right to withdraw from the purchase within a set period. Nothing in these Terms limits any right you have under mandatory consumer law.
- Türkiye. LevelUp Pro starts as soon as you confirm the purchase, at your request. Under Art. 15(1)(h) (and (ğ)) of the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği), the 14-day right of withdrawal does not apply to a service that has started with your approval within the withdrawal period. This does not affect your right to end the subscription at any time and get back the part you have paid for but not yet used (see Renewal and cancellation).
- EU, EEA and UK. If you are a consumer there, you can withdraw from your first LevelUp Pro purchase within 14 days of buying it, without giving a reason. Do it through the store that sold it: on the App Store, use Withdraw Transaction in your Apple Account's Purchase History; on Google Play, use Google Play's refund or withdrawal request. If you asked for Pro to start straight away, the store may keep an amount for the days you have already used.
- Other countries. Whether a right of withdrawal applies, and when it ends, depends on the law of your country. Send requests for App Store purchases to Apple; for Google Play purchases, contact Google Play or us.
Free and Pro
| Feature | Free | Pro |
|---|---|---|
| AI plan in onboarding | Once per account and device | Yes |
| AI plan when creating a new quest | No (opens LevelUp Pro) | Yes |
| Weekly review answer | Saved | Saved |
| Weekly rebuild from the review | No | Rebuild, read and apply |
| Quests, XP, classes, widgets, community | Yes | Yes |
| Alternative home-screen app icons | No | Yes |
Notes:
- The free AI plan is only offered during onboarding, for a new account that has no quest yet. If you choose Not now on the AI consent screen at that point, you cannot claim the free AI plan later, and AI plans for new quests then need LevelUp Pro. Your first quest then has no AI plan, so it tracks your progress without XP (see Your consent comes first). The app then offers ready-made plans you can add; their tasks do earn XP.
- The weekly rebuild is offered after you answer that a week felt too easy or too hard, while the next week still has unfinished AI-written tasks to change. The free preview shows a glimpse of the rebuilt week. Seeing all of it and applying it needs LevelUp Pro.
- Every AI feature needs your consent first (see AI plans).
- Members get a Pro badge, which other users can see next to their name in the community.
Fair use
- LevelUp Pro has monthly fair-use limits for each AI feature (AI plans for new quests, and weekly rebuilds). The limits reset at the start of each calendar month (UTC).
- We do not publish the number. The limits are set for normal personal use. If you reach one, the app tells you, and you can still create quests and write tasks yourself until the limit resets.
- An AI request that is refused or fails does not count toward the limit.
- We may change the limits only to prevent abuse or security risks, to comply with the law, or because of a significant change in the cost or terms of the AI service we use. If a change makes the limits lower for you, it applies from your next billing period and we tell you in advance, in the app where we can.
Changes to Pro
We may add Pro features at any time. We remove or reduce a main Pro feature only for one of the reasons listed under Fair use. We tell you in advance, in the app where we can, and the change applies from your next billing period. If we have to make it during a period you have paid for and it affects you more than slightly, you can end the subscription and get back the part you have paid for but not used. For Google Play purchases we refund it ourselves; for App Store purchases only Apple can refund, so ask Apple and we will support your request.
6. AI plans
#Who writes them
- LevelUp's AI plans are written by Claude, an AI made by Anthropic (Anthropic PBC). They are written by an AI, not by a person.
- Claude writes your plan when you ask for an AI plan for a goal or a new quest, and it rebuilds next week when you ask for a weekly rebuild.
Your consent comes first
-
Nothing about your quest is sent to Anthropic for an AI plan or a weekly rebuild until you tap Allow on the in-app consent screen. Not now sends nothing to Anthropic, and you can still write the plan yourself.
-
Tasks you write yourself are tracked but earn no XP or skill progress. So if you choose Not now and plan a quest yourself, that quest tracks your progress without XP. You can still add a ready-made plan, whose tasks earn XP.
-
You can turn AI plans off at any time in Profile › Settings › Privacy & Data. LevelUp then stops sending your quest details to Anthropic for AI plans and weekly rebuilds, and a plan that is still being written is stopped. Plans you already have stay in your quests.
-
Automatic checks are separate. Whether AI plans are on or off, your nickname, the quests you share and your comments are checked automatically by Anthropic's Claude before they are published (see Moderation). This consent screen does not cover them.
-
For an AI plan, LevelUp does not send your name, email or account details to Anthropic. What is sent, why, and how long it is kept are in the Privacy Policy.
-
If what we send, or who receives it, changes, the app will ask for your consent again before sending.
Check before you rely on it
- AI output may be inaccurate, incomplete or out of date. Check facts, and check that a plan suits you, before you rely on it. You can review and edit every task before you save a plan.
Note
AI plans are not medical advice. Talk to a doctor or another qualified professional before you start a new exercise or diet programme, and also if you have a health condition or an injury, are pregnant, or are unsure whether something is safe for you. Stop and get advice if something hurts or feels wrong.
- LevelUp provides wellness and habit plans. It does not diagnose, treat or prevent any illness, and it is not a medical device or a replacement for medical care.
- We do not promise any result from a plan, including any health, fitness or weight result.
Every screen that shows an AI-written plan (the plan review when you create a quest, the onboarding preview, and both weekly-rebuild screens) shows the notice "AI-generated, may contain mistakes; check before relying on it." Plans in the fitness, sports and cooking categories, and plans without a category, also show "Not medical advice: check with a doctor first." Where the plan can be reported, Report this plan sits under the notice (see Reporting a problem with an AI plan). This section applies to every AI plan and weekly rebuild, whatever notice the screen shows.
Using AI plans safely
- Do not include health or medical details in what you write for the AI, such as the extra details for a plan.
- Keep it realistic: start where you are, rest when you need to, and change any task that does not fit you.
- The AI is given safety rules. It is told not to write plans for things like extreme dieting, long fasts, purging, dangerous stunts, or sexual, illegal or self-harm content, and some requests are refused before they reach it. It may refuse a request or write a more cautious plan. These rules lower the risk but cannot rule out mistakes, so always check a plan before you follow it. When a request touches on eating or self-harm, the app suggests talking to a doctor or a local support line.
In an emergency
If someone is in danger right now, contact your local emergency services first. More help is on our Safety page.
Your responsibilities
- Do not use LevelUp's AI features to ask for or create illegal, sexual or self-harm content, or anything else prohibited by Anthropic's Usage Policy.
- Do not try to get around the AI's safety rules, our fair-use limits or the free-use rules, or put instructions for the AI into your quest text.
- Do not put other people's personal data into what you send.
- As far as we hold rights in an AI plan, you may use it for your own personal purposes. The AI may write similar plans for other people.
Reporting a problem with an AI plan
If an AI plan contains something harmful, offensive or plainly wrong, tap Report this plan under it in the app. Pick a reason (Dangerous advice, Self-harm or suicide, Sexual content, Violence or illegal activity, Hate speech, or Something else) and, if you like, add details (up to 500 characters). Your report goes to our moderators and helps us improve our safety rules. A copy of the plan, including any extra details you gave the AI, is kept with your report until you delete your account, as the Privacy Policy explains. More on reporting AI plans. You can also email us at [email protected].
Safety and young users
-
Minimum age: 13 (see Who can use LevelUp). LevelUp is not directed to children under 13.
-
AI disclosure: LevelUp's AI plans are written by Claude, an AI made by Anthropic, not by a person. You do not chat with the AI; it writes plans and weekly rebuilds from what you enter.
-
Safeguards in place today:
- consent before anything is sent to Anthropic for an AI plan, and you can withdraw it at any time;
- safety rules for writing plans, with refusals and a pointer to a doctor or a local support line;
- reporting of quests, comments and users in the app, and by email for people without the app;
- automatic hiding of content reported by established accounts at set thresholds, then human review, with a 24-hour review target;
- nickname removals and account suspensions.
-
What LevelUp does not do today: it does not verify age.
-
Blocking: you can block another user, so that neither of you sees the other's quests or comments, or can comment on them (see Blocking).
-
Automatic screening: nicknames, quests and comments are checked automatically by Anthropic's Claude before they are published (see Moderation).
-
Report this plan: you can report an AI plan in the app; the report goes to our moderators.
-
Law: we are committed to complying with the child-safety and privacy laws that apply to us, including Türkiye's Personal Data Protection Law (KVKK), the US Children's Online Privacy Protection Act (COPPA), under which LevelUp is not directed to children under 13, and, for users in the EU and EEA, the EU General Data Protection Regulation (GDPR).
-
Child-safety concerns: report them in the app with the reason Child safety, or see how to report and our child-safety standards. Do not send or forward the material itself.
7. Your content
#What counts as your content
Your content is what you put into LevelUp: your nickname and profile photo, your quests (titles, descriptions and tasks), your comments and replies, the details you add to a report, and anything else you write in the app.
You keep it
- You keep ownership of your content.
- You give us a worldwide, non-exclusive, royalty-free permission, only as needed to run, show and keep LevelUp safe, to host, store and copy your content, to adapt it to the app's layout, and to show it and make it available to people who use LevelUp, with your nickname. For content you publish to the community, this includes showing it to everyone who uses LevelUp. This permission lasts while your content is on LevelUp, and afterwards only for the copies others joined and the copies we keep as described in the Privacy Policy.
- When you publish a quest, other users can view, like and comment on it and join a copy of it (fork it). A copy has your quest's title, category and tasks, but not its description or your name. You give each user who joins a copy a non-exclusive, royalty-free, permanent licence to keep, use and change that copy in LevelUp for their own use. Copies others already joined stay with them after you delete your quest or your account, without your name.
- Some content is used with AI features after your consent (see AI plans).
What is public
- Everyone using LevelUp can see your nickname and initials, your level, character class and Pro badge, the quests you publish (title, description and tasks), your comments and replies, and how many people liked or joined your quests.
- Your nickname, chosen in onboarding, becomes visible to others when you first publish a quest or write a comment. You can change it from your profile (Edit Nickname). If an account has no nickname, for example because it was removed in moderation, others see the default name in their own app language instead ("Adventurer" in English).
- Your profile photo is shown only to you in the app.
- Do not put personal details in public content, yours or anyone else's.
Removing your content
- You can delete your quests and comments in the app. Deleting a quest also deletes its comments. Replies other people wrote to your comment stay.
- Deleting your account deletes your quests, comments and likes (see Ending these Terms).
Your responsibility
- You are responsible for your content. Publish only what you have the right to share, and make sure it follows these Terms and the Community Guidelines.
- We do not endorse what users publish.
Before they are published, your nickname, the quests you share, your comments and replies, and a new week for a quest you shared are checked automatically by Anthropic's Claude (see Automatic measures). The check can miss things, so you remain responsible for what you publish.
- Ideas and feedback. If you send us ideas or feedback, we may use them without any duty to you.
8. Acceptable use
#The Community Guidelines are part of these Terms. Read them before you publish or comment. LevelUp has zero tolerance for sexual content, intimate images shared without consent, child exploitation, harassment, hate and spam.
Before you post in the community for the first time, the app asks you to agree to the Community Guidelines and these Terms:
- When you share a quest, the Share to Community sheet has the checkbox "I agree to the Community Guidelines and the Terms of Use." It is never ticked for you.
- Before your first comment or reply, and before you change your nickname after onboarding, the app shows a short summary of the Community Guidelines, with links to the full Community Guidelines and these Terms, and you tap I agree.
We record when you agreed and which version of the Community Guidelines you agreed to (currently 2026-11-01). When that version changes, the app asks you again before your next post.
You must not publish, send or use LevelUp for anything that falls under the app's report reasons:
- Sexual content: nudity, sexual acts or sexual messages.
- Intimate images without consent: private or intimate photos or videos shared without the person's OK.
- Child safety: anything that sexualizes, exploits or puts a minor at risk.
- Self-harm or suicide: anything that encourages self-harm, suicide or eating disorders.
- Violence or illegal activity: threats, violence, weapons, drugs or other crimes.
- Dangerous advice: challenges or tips that could get someone hurt, such as extreme dieting or fasting.
- Spam: ads, scams or repeated junk.
- Harassment or bullying: anything that insults, threatens or targets someone.
- Hate speech: attacks on people for who they are.
- Something else that breaks the Community Guidelines.
You must also not:
- pretend to be another person, a brand or LevelUp, or use a nickname that is offensive or impersonates someone;
- share other people's personal data;
- infringe anyone's copyright, trademark or other rights;
- send false or bad-faith reports, or misuse the reporting system;
- break the law, or use LevelUp to help anyone else do so;
- misuse LevelUp in any of the ways listed under Licence to use the app.
9. Moderation
#This section sums up how we enforce these Terms and the Community Guidelines, which are part of these Terms. The detailed rules are in the Community Guidelines under What we do and Appeals.
Reporting
- In the app: open the … menu on a quest or a comment and choose Report quest, Report comment, or Report followed by the person's name, then pick a reason.
- Without the app or without an account: follow the steps on our Report content page and email us.
Automatic measures
Some measures are automatic, and a person can always review them:
- After a report. Some reports from established accounts hide content or remove a nickname at once, until a moderator reviews it.
- Suspended devices. When we suspend an account, we mark the app installations it used. Any account later used from a marked installation, including a new one, is suspended automatically (see When we can suspend or end your access). No person reviews this unless you ask.
- Automatic screening. The nickname, quests and comments you publish are checked automatically by Anthropic's Claude against the Community Guidelines, whether or not AI plans are on. Text that doesn't pass is refused or held for a moderator. The check is a safeguard, not a guarantee; reports and human review still apply. More in the Privacy Policy.
Human review and decisions
- Our moderators review reports, and posts the automatic check flags, with a target of 24 hours. Reports about child safety and intimate images are handled first.
- A moderator can dismiss the report, hide or delete the content, remove a nickname, or suspend the account. A suspended account can't be used with LevelUp, and its quests and comments are hidden from others. You can still delete it from the "Account suspended" screen.
- We may report illegal content to the authorities, and we act on orders from courts and authorities under the law that applies to us.
- We decide in a careful, objective and proportionate way, considering how serious the breach is, whether it was repeated, and the rights of everyone involved.
What you are told
- In the app, the author of hidden content sees it marked "Hidden by moderation" in their Posts tab, a post held by the automatic check shows a notice, and a suspended account sees the "Account suspended" screen.
- You can get the specific reasons by email: we tell you the rule in the Community Guidelines or these Terms, whether the decision came from a report, a moderator or an automated tool (including a device marker), and how to contest it.
- In-app reporters get a thank-you message. If you reported by email, we reply by email.
Contesting a decision
- If you think we got it wrong, about your own content or account or about something you reported, email us at [email protected] with your Support ID (in Profile › Settings › Help & Contact and on the "Account suspended" screen, which has a Contact support button for this). Tell us what was affected and why you think the decision is wrong.
What happens next
It costs nothing. A person looks at it again and tells you the result. If we were wrong, we reverse the decision.
- You can ask us to look again at any decision about your content, nickname or account for at least 6 months after it.
- This does not affect your right to go to court or to a competent authority.
Blocking
You can block another user from the … menu on their quest or comment in Explore (Block [name]). Neither of you then sees the other's quests or comments, and neither of you can comment on the other's. They are not told. You can block up to 1,000 accounts, and you can unblock someone at any time in Profile › Settings › Blocked Users. Blocking does not replace reporting: if someone breaks the rules, report them too.
10. Ending these Terms
#You can leave at any time
- You can stop using LevelUp at any time.
- You can delete your account at any time in Profile › Settings › Privacy & Data › Delete account. Your account is closed at once. If our servers cannot remove all of its data straight away, the rest is removed on its own, usually within minutes; the app tells you the deletion is in progress, and tells you again once it has finished. If you no longer have the app, see Delete your account.
- What is deleted and what we keep, and why, is in the Privacy Policy.
Warning
Deleting your account happens right away and cannot be undone. Deleting your account does not cancel LevelUp Pro. Cancel it in the App Store or Google Play (see LevelUp Pro).
When we can suspend or end your access
We may suspend or close your account, or remove content, if:
- you seriously or repeatedly break these Terms or the Community Guidelines;
- the law, a court or an authority requires it;
- it is needed to protect other users, third parties or LevelUp;
- the account belongs to someone under the minimum age;
- the account is used for fraud, or to abuse the free AI plan, the free preview or the fair-use limits; or
- the account is used from an app installation marked after another account's suspension (see Automatic measures).
The marker on those installations is kept, without a link to the deleted account, even after the suspended account is deleted, with no time limit set. It is removed only when we lift the suspension of the account that set it or of an account the marker suspended.
We act proportionately and, where the law requires it and we can, we tell you and give our reasons. A suspended account sees the "Account suspended" screen, and you can ask us for the specific reason by email (see What you are told).
If your account is suspended or closed, your store subscription is not cancelled automatically. Cancel it in the store to stop billing. If we end your access to LevelUp Pro for a reason that is not your fault, you can get back the part you have paid for but not used. For Google Play purchases we refund it ourselves; for App Store purchases only Apple can refund, so ask Apple and we will support your request. If we close your account because you seriously or repeatedly broke these Terms, we do not refund the rest of the period, as far as the law allows.
If LevelUp shuts down
We may stop offering LevelUp or a feature of it. If we close LevelUp, we will tell you at least 30 days in advance, on this page and, where we can, in the app, unless something outside our control forces us to stop sooner, and we stop selling new subscriptions. You can get back the part of LevelUp Pro you have paid for but cannot use. For Google Play purchases we refund it ourselves; for App Store purchases only Apple can refund, so ask Apple and we will support your request.
What survives
The sections on your content (for copies others joined and copies we keep), Liability, Law and disputes and any other terms that by their nature should continue, still apply after these Terms end.
11. Disclaimers and liability
#What LevelUp is, and is not
- LevelUp is a motivation and habit tool. We do not promise any particular result, including any health, fitness, weight or performance result. How you follow a plan, and whether a task is right for you, is your decision.
- We provide LevelUp with reasonable care and skill. LevelUp can sometimes be unavailable, for example during maintenance, and AI plans can contain mistakes or not suit you, so check them before relying on them. If LevelUp Pro does not work as we describe it, you have the rights consumer law gives you for a defective service, such as asking us to fix it, a price reduction or ending the contract; nothing in these Terms limits them.
- Other users' content is theirs. We are not responsible for it, but we act on reports (see Moderation).
- Services from other companies (for example the app stores) are provided under their own terms.
Limits on our liability
- If you are a consumer, we are liable under the law for loss we cause through our fault. We are not liable for loss that was not reasonably foreseeable, or to the extent you caused it yourself, for example by not following the safety guidance for AI plans.
- If you are not a consumer, and as far as the law allows, we are not liable for indirect or consequential loss or for loss of data, profits or opportunity, and our total liability is limited to the amount you paid for LevelUp Pro in the 12 months before the event that caused the claim.
What we do not limit
Nothing in these Terms limits or excludes:
- our liability for death or personal injury caused by our fault;
- our liability for intent or gross negligence;
- our liability for fraud; or
- any right you have as a consumer that cannot be limited by contract under the law that applies to you, such as Turkish Consumer Protection Law No. 6502 or the mandatory consumer law of your country of residence.
12. Law and disputes
#- These Terms are governed by the law of the Republic of Türkiye.
- If you are a consumer in Türkiye, you can take a dispute to the Tüketici Hakem Heyeti (consumer arbitration committee) of your province or district, up to the monetary limit set each year (for applications in 2026, disputes below TRY 186,000), or to the consumer courts (Tüketici Mahkemeleri) above that limit, after the mediation the law requires.
- If you are a consumer living in the EU or another country, this choice of law does not take away the protection of the mandatory rules of the country where you live, and you may also bring a claim in the courts there.
- If you use LevelUp as a merchant (tacir) for your business, the courts and enforcement offices at our registered seat in Istanbul have jurisdiction.
- Before you start a formal dispute, please write to us at [email protected]. Most problems can be solved that way.
Other legal terms
- Languages. These Terms are published in English and Turkish, and both versions are equally valid. If they differ, the reading more favourable to you applies. The app is also available in other languages, but these Terms are not translated into them.
- Whole agreement. These Terms, the Community Guidelines and, where it applies, Apple's Standard EULA are the whole agreement between you and us about LevelUp.
- If a term is invalid, the rest of these Terms still apply.
- No waiver. If we do not enforce a term straight away, we can still enforce it later.
- Transfer. We may transfer these Terms to a company that takes over LevelUp, and we will tell you if we do. Your rights under these Terms do not get worse because of such a transfer. You may not transfer these Terms to someone else.
13. Apple App Store
#This section applies if you got LevelUp from Apple's App Store. If it conflicts with anything else in these Terms, this section wins for App Store users.
- Parties. These Terms are between you and Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi only, not Apple. Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi, not Apple, is solely responsible for LevelUp and its content.
- Scope of licence. Your licence to use LevelUp is limited to Apple-branded products that you own or control, and to the uses allowed by the Usage Rules in Apple's Media Services Terms and Conditions, except that LevelUp may also be used by other accounts linked to the purchaser through Family Sharing or volume purchasing.
- Maintenance and support. Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi alone is responsible for any maintenance and support for LevelUp, as set out in these Terms or required by law. Apple has no duty at all to provide maintenance or support for LevelUp.
- Warranty. Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi is solely responsible for any product warranties, whether express or implied by law, as far as they are not effectively disclaimed. If LevelUp fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, of LevelUp to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind for LevelUp. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are the sole responsibility of Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi.
- Product claims. Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi, not Apple, is responsible for dealing with any claims by you or a third party relating to LevelUp or your possession or use of it, including: (a) product liability claims; (b) any claim that LevelUp fails to conform to any applicable legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that LevelUp, or your possession and use of it, infringes that third party's intellectual property rights, Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Send any questions, complaints or claims about LevelUp to: Newyares Teknoloji Bilişim Sanayi İç ve Dış Ticaret Anonim Şirketi, Fikirtepe Mahallesi, Rüzgar Sokak No: 44A, A1 D: 197, 34720 Kadıköy / İstanbul, Türkiye; phone +90 532 698 88 78; email [email protected].
- Third-party terms. When you use LevelUp you must follow any third-party agreement that applies to you, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
14. Google Play
#This section applies if you get LevelUp from Google Play.
- Your use of Google Play, and your purchases there, are also governed by Google Play's own terms of service and policies. Google is not a party to these Terms and is not responsible for LevelUp.
- LevelUp Pro bought through Google Play is billed to your Google Play account. You manage and cancel it in the Google Play app: tap your profile icon, then Payments & subscriptions › Subscriptions.
- Refunds for Google Play purchases follow Google Play's refund policies. You can also contact us; we may be able to issue a refund ourselves (see Refunds).
15. Changes to these Terms
#- We may change these Terms, for example when LevelUp changes or the law requires it. The version and effective date are at the top of this page, and the change log lists every version.
- If a change is significant or makes your position worse, we tell you at least 30 days before it takes effect, on this page and, where we can, in the app, unless the change is needed sooner for legal or safety reasons. A change that makes your position worse does not apply to a LevelUp Pro period you have already paid for; it applies from your next billing period.
- Changes apply from their effective date and do not apply to anything that happened before. If you keep using LevelUp after a change takes effect, the new Terms apply to you. If you do not agree, stop using LevelUp, delete your account and cancel LevelUp Pro in the store.
- You can ask us for an earlier version of these Terms.
